User Agreement for Autotronik Ltd Services
1. General Provisions
1.1. Autotronik Ltd (hereinafter – “AUTOTRONIK”) offers Internet users (hereinafter – the “User”) the opportunity to use its services under the terms and conditions of this User Agreement (hereinafter – the “Agreement”, “User Agreement”). This Agreement shall take effect upon the User’s express agreement with its terms according to Clause 1.4 hereof.
1.2. AUTOTRONIK offers Users access to services including uploading, analysis, and modification of files. All currently available services, as well as their development and/or addition of new services, shall be the subject of this Agreement.
1.3. The use of AUTOTRONIK services shall be regulated by this Agreement and Privacy Policy, and terms of using certain services. This Agreement may be amended by AUTOTRONIK without notice, and a new revision of this Agreement shall take effect when posted online, unless otherwise stated in the new revision.
1.4. By using any services or certain functions, or by registering, the User is deemed to have accepted the terms of this Agreement in full. If the User does not agree to any provisions of this Agreement, they must not use AUTOTRONIK services. If AUTOTRONIK makes any amendments to this Agreement to which the User does not agree, the User shall cease to use the services.
2.User Registration. User Account.
2.1. To access certain services or specific functions, the User must register and create a unique account.
2.2. Upon registration, the User shall provide valid and complete information and must keep it updated. AUTOTRONIK may block or delete accounts that provide invalid or incomplete information.
2.3. AUTOTRONIK reserves the right to request verification of registration details. Failure to comply may result in account suspension or termination.
2.4. Personal data will be processed according to AUTOTRONIK’s Privacy Policy.
2.5. Users must keep their login credentials secure and are responsible for all activities conducted under their account.
2.6. Any actions performed via the User’s account are deemed to be performed by the User unless AUTOTRONIK is notified of unauthorized access.
2.7. The User must promptly report unauthorized access or security breaches.
2.8. Users may not reproduce, copy, sell, or exploit any part of the services without written permission.
2.9. AUTOTRONIK may block, delete accounts, or restrict access without reason, particularly for violations of this Agreement.
2.10. Users may request account deletion by contacting support at support@autotronik.co.uk.
3.General Usage and Storage
3.1. AUTOTRONIK may impose usage limits based on geography, service type, data storage, file size, and request frequency. Automated requests may be blocked.
3.2. AUTOTRONIK may send service-related notifications to users.
4.User Content
4.1. The User is responsible for ensuring their content complies with legal requirements and does not infringe on third-party rights.
4.2. AUTOTRONIK may adapt or process User content as necessary to meet technical requirements.
5.Terms of Service Use
5.1. Users are responsible for ensuring their use of the service complies with applicable laws.
5.2. Users must not:
– Violate third-party rights or cause harm
– Misrepresent their identity
– Facilitate or participate in violations of this Agreement
– Breach legal standards
5.3. Files must be submitted through task creation (“Processing Task”).
6.Intellectual Property
6.1. All content and materials within AUTOTRONIK services are the property of AUTOTRONIK, Users, or third-party rights holders.
7.Limitation of Liability
7.1. Services are used at the User’s own risk. AUTOTRONIK does not guarantee fitness for a particular purpose.
7.2. AUTOTRONIK is not liable for:
– Service disruptions or errors
– File or data loss
– Any damage to vehicles or equipment resulting from use of services
7.3. Information and files obtained through the service are used at the User’s discretion.
7.4. Claims must be submitted via the support ticket system.
8.Other Provisions
8.1. This Agreement supersedes prior agreements between the User and AUTOTRONIK.
8.2. This Agreement does not create partnership or employment relationships.
8.3. Invalid provisions do not affect the validity of the rest of the Agreement.
8.4. AUTOTRONIK’s inaction in response to a breach does not waive its right to act in future cases.
9.Refund / Credit and Warranty Policy
9.1. As AUTOTRONIK provides digital services that are uniquely created for each specific ECU file and cannot be reused on another vehicle, and due to the sensitive nature of reading and writing processes on the user’s side, AUTOTRONIK does not accept any refunds under any circumstances.
9.2. By submitting a file, the User acknowledges they have verified compatibility and agree to these terms.
9.3. Support is available for valid issues through the support ticket system, but no refund or credit shall be issued.
If you do not agree with these terms, do not use AUTOTRONIK services.
